WORKERS COMPENSATION: AREAS OF PRACTICE
A workers compensation case generally arises if a worker
is injured on the job.
Who is Covered by Workers Compensation:
Generally, anyone who works for wages is covered by workers compensation.
Is My Injury Covered by Idaho Workers Compensation?:
If your employment originates in Idaho, then your case would probably be an
Idaho Workers Compensation Claim. If you have specific questions regarding
which state your claim should be filed in, you can contact our office.
If I Have an Idaho Workers Compensation Claim and Need
to File, Where Do I Do That? You should tell your employer right away
if you are injured on the job. In Idaho, if the employer fails or refuses
to file a claim for you, you can do so by contacting the Idaho Industrial
Commission at 1-800-950-2110 or
www.iic.idaho.gov. Remember, you should ensure that a claim is filed as
soon as possible so that it is not determined to be untimely. You can
contact our office if you have additional questions regarding this process.
If My Workers Compensation Claim in Idaho is Denied,
Can I Fight That?
Yes. If you feel that your Idaho Workers Compensation
Claim has been wrongfully denied, you can file a complaint with the Idaho
Industrial Commission. Our office may be able to help you work through that
process.
I Have Received an Impairment Rating, is My Idaho
Workers Compensation Case Settled?
Only if you have received and signed a lump sum
settlement agreement and that agreement has been approved by the Idaho
Industrial Commission. Sometimes injured workers receive an “impairment
rating” from a doctor and mistakenly believe that their case is “closed” or
“settled.” Our office can help you determine if your case has been
“settled” or if you may be entitled to additional benefits.
I Haven’t Been Able to Return to Work Since My Injury
and My Benefits Have Been Stopped, What Can I Do?
You can contact our office. We may be able to help you
by evaluating your claim and determining whether you may be entitled to
additional benefits. |
